You can request mediation during your appeal. However, it is up to the appellate judges whether or not a case is appropriate for mediation. Typically, the appellate court will ask the other side if they are agreeable to mediation. The appellate court will then make a decision on whether or not mediation is appropriate. However, if your case is in the Fifth District Court of Appeals, there’s a special program there, where the court may on its own motion refer a case to mediation.
