If you mediate, an attorney is not required. However, if you have an attorney, it’s important for your attorney to come to mediation with you. Your attorney will be able to offer you legal advice and his or her opinion during the mediation. However, if you do not have an attorney, a mediator is not allowed to offer you an opinion, or offer you advice. If the mediation is not successful, then you will have to go to trial. And at that point, you may or may not choose to have a lawyer.
