Mediation is confidential in circuit civil cases. What that means is that the offers that go back and forth between the parties is confidential. That means it cannot be disclosed to third parties or to the Court. The the judge will not know who offered what in order to reach an agreement. Once you reach an agreement, it is in the discretion of the parties whether or not you choose to file that with the Court. If you file with the Court, it may become public record at that point or you may choose not to file it with the Court and you all may decide at that point to also make that agreement confidential, in that it cannot be shared with third parties.
