Why choose mediation?

If resolved costly and lengthy litigation is avoided.

The expense of mediation is shared between the parties and tends to be a fraction of the cost of litigation.

Mediation reduces or minimizes the conflict between the parties. This is especially important in the case of family law mediation when children are involved.

Mediation is creative. The parties are able to be creative in the resolution of their case as opposed to following “the standard” for courts.

The parties control the outcome of their case, not the courts or lawyers.

Mediation is less confrontational and less stressful. The parties work on a resolution to their dispute as opposed to posturing for trial or building a case against each other.

How is mediation scheduled?

Your case can be court ordered to mediation or the parties on their own or through their legal counsel can agree to mediate. The parties then schedule a date and time for mediation dependent upon the parties and the mediator’s availability. 

What is the cost of mediation?

The mediator’s fee is $250.00 per hour for family law mediations where the yearly joint income of the parties is below $150,00.00.  If their income exceeds $150,000 per year the hourly rate is $300.00 per hour. For civil mediations the mediator’s hourly fee is $300.00 per hour. Said fee is usually divided between the parties unless the parties agree or the court orders otherwise.  Payment is due at the conclusion of mediation.  

There is no cost for travel for mediations held within Volusia or Flagler County. Mediations outside Volusia or Flagler County will be charged a travel fee of $50.00 per hour.

There is a 48 hour cancellation policy.  Any mediation cancelled within 72 hours of the date of the scheduled mediation will be charged a $500.00 cancellation fee.
